Squad Assault No-CD request

This is not my first request here regarding a No-Cd for Squad Assault: West Front for the lastest version (which is v1.08).
I'm requesting here (again) because the post in where I previously requested this No-CD patch was locked:
http://fileforums.com/showthread.php...=Squad+Assault

I really don't undestand why this happened, the moderator that locked that thread (GLH) said it was because rule#8 but that rule states the following:
"No bumping your own thread unnecessarily" and I find this quite odd because:
1- That thread wasn't mine (it was grantalope's thread)
2- I don't think it was "unnecessarily" because it passed 20 days (which is quite long -> more than the "usual" 2 weeks) between my first post in that thread and the second post (the bump)!!

P.S: I do own an original copy of Squad Assault but I do want to be able to play the v1.08 of that game without the original CD in my drive and furthermore I want to be able to have working backups because first it's my right (I do have the original) and second if the original CD get's any sort of damage that prevents it from working I will NOT get a replacement (or a refund) from where I bought that game (that why backups exists and are legal)!

Finally, I would be very appreciated to anyone that tries to help me in this one. Thanks in advance.

1. Yes its ok to have a backup IF the agreement says so :P If it says your not to make one, then you cant :P Alot of people think they can backup everything they own, but its not always the case.

2. If your CD is damaged, you can contact the publisher and get a new CD for a fee or in some cases free. If the damage occurs within 30 days then you can ask for a replacement at your local store or a refund (refund is at the store's discretion if they want to or not).

3. Not all backups are legal, refer to 1.

4. It may take time for a no-cd to appear as it will have to be of interest to groups/crackers/joe bloggs, but if they feel the game is pants they may avoid it and some other person may send one out. But you may be in for a longgggg wait.

Probably when someone requests a patch without posting its protection is because he doesn't know what protection that game has!!

Replying to your question:
I don't know for sure which protection Squad Assault has. The original version of squad assault that is installed straight from the CD ( version 1.0 ) doesn't have any protection at all! Only the following patches added some sort of Protection -> The only way that I'm able to play the game patched to the lastest version (v1.08) is to have the original CD in the drive.

If it helps I read in an another forum that the protection above is CD Checks, but the guy that said that wasn't 100% sure if I'm not mistaken!

In the country where I live (Portugal) the copy protection laws states that you can have as many as Backup copies that you want IF you OWN the ORIGINAL.

I own Squad Assault for more than a year now so I certain that I will NOT get a replacement copy or refund if my ORIGINAL copy goes CAPUT!

Has I said before I own the game for more than a year and the latest patch came out something like more than 5 month ago so I think I waited long enough (in order to make a request that is) :P

And thats the problem there. So many different countries with so many different law's covering the same thing. Then there's the same laws with little variations. The www has brought us all closer together but with the backing up side of things some people get confused as the rules on one site about it dont cover the rules elseware. yet ? Now we see the problem in all its glory (confusion). Sh*t i just managed to confuse myself and i had a understanding of the law in my own country @ least

To response of Portugese guy, if the owner of the game says you can backup then yes you can, if they say you cant then you cant, simple as that, no matter your intepretation of the copyright laws :P

If you re-read them, it will say your entitled to backup software if your given authorisation from the owners to do so. If they didnt then you just cant make one, but you can if you wish aslong as you dont get caught lol

Hey DABhand,

If the laws in the country you live in ALLOW you to create backups of any software then you MAY do it, no matter what the EULA of that particular software says. Do some research...

Joe

Im afraid your wrong joe.

You asked me to read your laws, read them yourself and you will see what I said in my previous post about authorisation.

DABHand,

I'm getting a bit tired, you know... A quote from Hungarian law, taken from a page of Artisjus, the very organization that protects authors:

Quote:
1999. évi LXXVI. törvény a szerzői jogról
(...)
59. § (...)
(2) A felhasználási szerződésben sem zárható ki, hogy a felhasználó egy biztonsági másolatot készíthessen a szoftverről, ha az a felhasználáshoz szükséges.
(...)
Meaning: Not even the EULA can take away the user's right to create a backup copy of the software, if that is required for (normal) usage.

[Edit] Oh yeah, and the constitution and other local laws have precedence over such company/person-to-company/person agreements... By the way, every software company is free to NOT export stuff to a given country. (It would be a stupid idea to do so, only because this "counter restriction", though...)

Next time, do me a favor, and DO some research, okay?

Joe

P.S.: Yes, this isn't a full-English post, I know. You know why...

Joe is correct!
When people or products are in a certain country they are subjected to the laws of that country which supersedes any other laws that may exist (EULA for example).

Let me give an example:
-Laws in Portugal like in most parts of the world states that you must drive in the right side of the road but if I drive with my car in United Kingdom for example I MUST drive in the left side of the road because I'm subjected the UK laws EVEN if in my country the law states that I must drive in the right side or if my car is prepared to be driven in the right side (the driver position is on the left).
This happens with ALL laws whatever they are and that includes copy protection laws!

What I see is this in that line.

An application may be backed up one per user per contract.

Im not great with hungarian but isnt szerződésben = per contract?

Which means EULA (your contract when you buy the software which you agree to when installing) is in effect, if they say no then you cant.

And also dont be nasty to others when you talk to them, you may have a triple post count, but that doesnt give you the right to talk down at me.

Yeah, the CD checks were introduced in patches. However, this isn't the typical CD check since burning an ISO from the original doesn't work.

So there may maybe custom checks that is specific to the original CD structure.
