Hmm, the game does not require a patch. I backed this up myself with no problems. Try backing up to your hard-drive with dvd2xbox, the newest version. This is what I used and have had no issues.
Also, are you launching the game after your dashboard loads? If you are using evox, turn off IGR and trainers. This used to cause issues on many games in the past.
Clear out your xbox cache, the XYZ drives as well.
